Moscow court bans the sale of Samsung smartphones in Russia

The Moscow Arbitration Court has banned the import and sale of the new Galaxy Z Flip3 and another 60 models of Samsung smartphones in Russia. RIA Novosti writes about it . The reason was the lawsuit of the Swiss company Sqwin SA, which accused Samsung of patent infringement while developing the payment service Samsung Pay.

Sqwin SA has accused Samsung of infringing the rights to an invention called "Electronic Payment System". According to the description of the patent, it is intended for payment using a mobile device and the seller's cash register.

The court imposed restrictions on the sale of 61 models of smartphones that support the specified service, ranging from the Samsung Galaxy J5, released in 2017, up to the latest flagships Galaxy Z Flip3, Galaxy Z Fold3 and the Galaxy S21 family. In fact, almost all modern Samsung models were banned, because they have Samsung Pay installed. It is important to note that the defendant appealed the court's decision and it has not yet entered into force, so for now Samsung can import and sell its smartphones in Russia.

Samsung Pay is the third most popular contactless payment service in Russia, used by 17% of smartphone owners. It is second only to Google Pay (32%) and Apple Pay (30%). Experts argue that judging by the description of the claim, the latter two may have similar claims on the part of Sqwin SA.

A representative of Samsung Electronics previously explained to Kommersant that the company is studying the documents on the claim and does not plan to change anything in its activities. Lawyers, however, note that the Korean company has three options: to challenge the decision of the court in a higher instance, to challenge the patent itself for the lack of novelty in the invention, or to negotiate with the plaintiff about licensing. The second option looks the most promising.
